What are the responsibilities of the Planning and Zoning Commission?: The Planning & Zoning Commission is charged with preparation, adoption and from time-to-time amendments of the City’s Comprehensive Plan. The Commission also holds public hearings and makes recommendations to the City Council on subdivision plats, proposed rezonings, and other land use matters established by ordinance.

1. Can I change the zoning or Comprehensive Plan designation of my property?: Zone changes and Comprehensive Plan amendments require Planning & Zoning Commission review and the approval of the City Council. Zone changes may require a Comprehensive Plan amendment.

2. What are setbacks?: The term setback means the required distance separating a building or structure from a property line. Setback regulations for buildings are included in the Zoning Ordinance in Chapter 16.

3. What businesses can I operate on my property?: The City has adopted land use regulations for operating home businesses. The Dacono City Clerk licenses all home businesses. Contact the City Clerk at 303.833.2317 x123.

5. What are the responsibilities of the Board of Adjustment?: The Board of Adjustment holds public hearings and determines appeals from refusals of building permits, exceptions to the zoning regulations and to authorize variances from the strict application of the zoning regulations. Parties aggrieved by the findings and decisions of the Board of Adjustment may appeal the same to the City Council.

6. What is a variance?: A variance is a grant of relief by the Board of Adjustment, from specific limitations of the zoning ordinance. A variation is granted so a structure can be constructed or modified in a unique manner which does not meet some aspect of the Zoning regulations. Variances for uses are not permitted.

7. Where can I find a survey of my property?: Contact the Weld County Recorder of Deeds. Recording Department is responsible for processing and preserving documents presented for public record. Recorded documents in the office range from 1865 to the present. Most of the documents are available electronically. Included in the records are: real estate records and subdivision maps.

8. What is the Comprehensive Plan?: The Comprehensive Plan is an adopted document which provides a guide to the physical development of the City. It is a basic tool to guide zoning and policy-making decisions.

9. What is zoning?: Zoning provides the standards and regulations that apply to land and structures in the City. These standards and regulations help implement the Comprehensive Plan of the City of Dacono which are the goals, policies and recommendations of how development in the City (long-term) is to be achieved. The City of Dacono has numerous zoning classifications. Each one has a list of permitted uses and standards for building setbacks, densities, and heights. Some have specific design guidelines. Please refer to the Zoning Ordinance for details on each zoning classification.

10. Can I have a home-based business?: Home-based businesses are termed "home occupations" in the Zoning Ordinance. Home occupations meeting certain criteria are permitted in any residential district. Home occupations do not allow outside employees, exterior storage, the emission of odor, dust, gas, noise, vibration, smoke, heat, or glare beyond the boundary of the lot, or business activity between the hours of 9 PM and 9 AM. Businesses specifically prohibited as home occupations are restaurants, commercial stables/veterinary offices, appliance repair, welding or metal fabrication or equipment rental. 11. What work requires a building permit?: The City of Dacono requires permits for indoor or outdoor structural work, freestanding structures (such as a fence, shed, or pool), or major changes to the living area of a home. The permit process ensures that minimum safety standards are met and that construction meets local building and zoning requirements. Make sure you understand the building codes and local ordinances before proceeding with a major improvement project. All commercial and multi-family projects require permits.

12. How can I contact the building official?: Contact the City of Dacono Department of Community Development for information about building permits, inspections, and fees, at 303.833.2317 x128 between 8:00 a.m. and 5:00 p.m., Monday through Friday or contact us through the website.

13. Can someone else own the minerals under my property? How can I tell if I own my minerals?: Yes, it is possible the mineral ownership may be different from the surface ownership. A deed/title search may be necessary for one to determine who actually owns the minerals under a piece of property.

14. When is the next Planning & Zoning Commission meeting?: The Planning Commission meets the 2nd and 4th Tuesday of each month at 6:00 p.m. Agendas are posted online.
